By starting to use the services provided by MyHKTour, you agree that you have read, understood, and accepted these Terms of Use. If you do not agree to these Terms of Use, you cannot use MyHKTour's services.

Cancellation Terms
  Cancellations made 5 days or more before the activity date will incur a 20% fee of the total deposit.
  Cancellations made 3 to 4 days before the activity date will incur a 50% fee of the total deposit.
  Cancellations made within 0 to 2 days of the activity date are non-refundable (100% of the deposit).

1.Your Relationship with MyHKTour 
  1.1 These Terms of Use govern your use of the "MyHKTour Platform" (.rezio.shop) and other online or offline services we provide, including travel-related activities conducted through MyHKTour (collectively referred to as "MyHKTour Services"). 
  1.2 These Terms of Use constitute a binding agreement between you and MyHKTour. While using MyHKTour Services, you must accept all additional terms related to the service and MyHKTour's "Privacy Policy," which are incorporated into these Terms of Use when mentioned. 
  1.3 MyHKTour may modify or update these Terms of Use at any time as required by law or necessity, without prior notice. When changes occur, we will post the updated version on our website (.rezio.shop) and indicate the revision date. Your continued use of the services constitutes acceptance of the updated terms. Please refer to the latest version regularly.

2.MyHKTour Services 
  2.1 MyHKTour Services include purchasing travel itineraries, transfer services, tickets, and other travel experiences offered by us or third-party providers ("Providers") through the MyHKTour Platform. You agree that the chosen services are for personal use only and may not be used for commercial purposes. We reserve the right to change, suspend, or terminate any service, or impose new rules, limitations, or amendments to services, without prior notice. 
  2.2 When using the services, you may need to pay fees to Providers and comply with their terms of service. You agree to be responsible for these fees and adhere to the related terms. 
  2.3 We will strive to maintain the operation of the services and platform, but we do not guarantee that services or the platform will be free from external disruptions. You agree that we have the right to refuse your use of the platform or services and may change, suspend, interrupt, or terminate services or the platform.

3.Platform Content 
  3.1 "Platform Content" refers to all materials presented or used on the MyHKTour Platform, including text, photos, images, videos, illustrations, sounds, data, and code. These contents are owned by MyHKTour or authorized entities and are protected by intellectual property laws. We reserve the right to change or remove platform content at any time. 
  3.2 Under these terms, we grant you a limited, non-exclusive, non-transferable license to use or access the platform content. You agree to use it solely for personal, non-commercial purposes and not to infringe on our rights. You assume all risks associated with using or accessing the content, and we are not responsible for content errors. 
  3.3 We cannot guarantee the accuracy or authenticity of content provided by other third-party users.

4.Information You Provide 
  4.1 You agree to use your personal information in accordance with the "Privacy Policy." 
  4.2 You agree to receive travel review invitations via SMS, email, or the platform. Your reviews may be uploaded to the platform, and you must ensure the content is accurate and free from illegal or inappropriate information. 
  4.3 Your reviews may be used by MyHKTour, Providers, or other users. You grant MyHKTour a non-exclusive, global, royalty-free, perpetual, transferable license to use review content. Your grant does not affect your ownership of the data.               
  4.4 You warrant that the information you provide does not violate any laws or infringe on others' rights, and MyHKTour is not responsible for this. 
  4.5 We may remove any information you provide at our discretion.

5.Your Commitments 
  5.1 You must use the services only in accordance with these terms and are legally responsible for all actions. 
  5.2 You agree to: 
    (a) Not copy, reproduce, distribute, publicly display, transmit, or broadcast any part of the service without our written permission, including modifying, destroying, or circumventing licensed software, and using trademarks or service marks. 
    (b) Not circumvent, damage, or interfere with the security measures of the services, nor extract content or use the service in a manner inconsistent with personal use. 
    (c) Not translate, reverse engineer, disassemble, or intrude upon the service unless permitted by the terms or rules. 
    (d) Not use, display, imitate, or process the service through other applications or websites unless we provide embedding methods. 
    (e) Not harass or harm others, provide false personal information, or impersonate others. 
    (f) Not collect or attempt to collect others' personal information, or restrict or prohibit others from using the service. 
    (g) Not use the service to contact or engage in commercial advertising or data collection unless explicitly permitted. 
    (h) Not engage in fraud, violate information security, crack passwords, unlawfully store data, or participate in other illegal activities.

6.Order Confirmation and Refund Policy 
  6.1 You may purchase services through the platform; some orders are immediately confirmed, while others require confirmation. You agree to receive order notifications and understand that the timing of order results is for reference only. 
  6.2 MyHKTour reserves the right to change service prices and fees, with changes communicated via SMS, email, website, or App. By using the service, you accept the updated prices and fees. 
  6.3 We have the right to refuse or cancel orders that violate terms. 
  6.4 You agree to pay the order amount using the designated payment method. Payments made are non-refundable unless otherwise agreed. 
  6.5 If services are provided by Providers, they alone accept or reject bookings and are responsible for delivering services. You can inquire about service details from the Providers or MyHKTour. 
  6.6 Services may incur additional taxes or fees, which you must pay. MyHKTour cannot guarantee the accuracy of displayed content. If an order is canceled, we will notify you as soon as possible. 
  6.7 If you cancel a booking within the cancellation period, refunds will be processed according to the payment method. Refund amounts may vary due to exchange rates or fees. 
  6.8 Use of Electronic Vouchers: 
6.8.1 After a successful booking, you will receive an SMS or email confirmation containing an electronic voucher. You may print the voucher for use. 
6.8.2 You must comply with usage terms and conditions, including appearing at the designated location within the validity period and providing requested documentation. Failure to meet conditions may result in non-redemption or denial of a refund. 
6.8.3 If an electronic voucher is lost or stolen, we or Providers are not obligated to replace or redeem the service. Attempts at fraudulent redemption may result in refusal and non-refund.

7. Limitation of Liability
  7.1 You understand that platform content may be provided by third-party suppliers, and agree that we make no representations or warranties regarding the accuracy of such platform content, and you agree not to hold us responsible for any content provided by suppliers.
  7.2 You agree that any content transmitted or received through the MyHKTour platform is not confidential, and your communications may be read or intercepted by others. You understand and acknowledge that no confidential, trust, or other cooperative legal relationship is established between you and us.
  7.3 To the fullest extent permitted by law, you agree that MyHKTour, and our directors, officers, employees, and agents, will not be liable for any direct, indirect, special, incidental, consequential, punitive, or exemplary damages resulting from any breach of these Terms of Use, use of the MyHKTour platform, or any other negligence.
  7.4 To the fullest extent permitted by law, if you are dissatisfied with our services, your sole remedy is to stop using our services. In any event, if we are found liable, the maximum amount of compensation will be limited to the total amount you paid to us in the twelve months prior to the claim.

8. Indemnification
  8.1 You must indemnify and hold harmless MyHKTour and our directors, officers, employees, and agents from any claims by third parties arising from your or any user of your MyHKTour account’s access to the MyHKTour platform or use of MyHKTour services in violation of these Terms of Use or infringement of others' intellectual property or other rights. This indemnification includes but is not limited to all litigation costs, attorney's fees, settlement fees, and other losses.
  8.2 Regarding third-party claims, MyHKTour may require you to defend against any claims or legal actions and participate in any settlement negotiations. However, you may not take any legal action that may be detrimental to our rights without our prior written consent.

9. Termination
  9.1 These Terms of Use will continue to apply until terminated by us. We reserve the right to terminate or suspend your use of MyHKTour services, access to the MyHKTour platform, or your account immediately, without prior notice, if you violate any provision of these Terms of Use or if we deem it necessary.
  9.2 If these Terms of Use are terminated under Section 9.1, you agree that, to the fullest extent permitted by law, we will have no obligations or liabilities to you, and may cancel any orders placed before the termination without refunding you.
  9.3 You understand and agree that even after termination of these Terms of Use, any provisions that by their nature are meant to continue will remain in effect, including but not limited to limitation of liability provisions.

10. Visas and Insurance
  10.1 Regardless of your nationality and travel destination, you should be aware of the current entry requirements for your destination. Since visa and health check regulations may change without notice, we recommend you confirm the current regulations before traveling.
  10.2 For your own benefit, we recommend purchasing comprehensive travel insurance before departure.

11. Dispute Resolution
You agree that the initial court of jurisdiction for any disputes or claims arising from your use of MyHKTour services will be the primary court located in the place of business of MyHKTour.

12. Miscellaneous
  12.1 If any provision of these Terms of Use is found to be invalid, illegal, or unenforceable, the remaining provisions will remain in full force and effect.
  12.2 We may assign these Terms of Use or any rights and obligations arising under them to any third party, and may delegate any obligations under these Terms of Use to any third party. You may not assign these Terms of Use or any rights or obligations arising under them without our prior written consent.
